শর্তাবলী

www.emedicine.com.bd (“emedicine.com.bd”, ” ইমেডিসিন “, “ওয়েবসাইট”, “ফার্মেসি”, বা “আমরা”) এ স্বাগতম। এই ওয়েবসাইট/অ্যাপটি প্যান ভেঞ্চারস লিমিটেড দ্বারা পরিচালিত এবং পরিচালিত হয় যার নিবন্ধিত অফিস ঢাকা, বাংলাদেশে রয়েছে।

ওয়েবসাইট, www.emedicine.com.bd এর সাথে সংশ্লিষ্ট মোবাইল অ্যাপ্লিকেশন (” ইমেডিসিন “, “ওয়েবসাইট”, “ফার্মেসি”, “আমাদের” বা “আমরা”)। এই ওয়েবসাইটটি প্যান ভেঞ্চারস লিমিটেড দ্বারা পরিচালিত এবং পরিচালিত হয়, বাংলাদেশের আইনের অধীনে অন্তর্ভুক্ত একটি কোম্পানি, যার নিবন্ধিত অফিস রয়েছে মিরপুর, ঢাকা, বাংলাদেশ (“আমরা”, “কোম্পানী”, “প্যান ভেঞ্চারস” “আমাদের” বা “আমাদের”)

এখানে উল্লিখিত শর্তাবলী (“শর্তাবলী”) কোম্পানির মধ্যে একটি চুক্তি গঠন করে, এবং একজন প্রাকৃতিক বা আইনি ব্যক্তি যিনি ওয়েবসাইটটি অ্যাক্সেস করেন এবং/অথবা ব্যবহার করেন (“আপনি” বা “আপনার”)।

ওয়েবসাইটটি হল এমন একটি প্ল্যাটফর্ম যা ভোক্তাদের ওষুধের পণ্য যেমন প্রেসক্রিপশনের ওষুধ, ওভার দ্য কাউন্টার ওষুধ ইত্যাদির গ্রাহকদের অনলাইন ক্রয়ের সুবিধা দেয়, ইমেডিসিন তার লাইসেন্সকৃত প্রাঙ্গনে (“পণ্য”) এর মাধ্যমে বিক্রি করে।

ওয়েবসাইট ব্যবহার করে, আপনি স্পষ্টভাবে শর্তাবলী দ্বারা আবদ্ধ হতে সম্মত হন । আপনি যদি শর্তাবলীর সাথে একমত না হন তবে দয়া করে ওয়েবসাইটটি ব্যবহার করা থেকে বিরত থাকুন। অনুগ্রহ করে মনে রাখবেন যে আপনার ওয়েবসাইট, পণ্য, অফার বা প্রচারগুলি পণ্য এবং পরিষেবাগুলির (নীচে সংজ্ঞায়িত) যা আমাদের বা আমাদের সহযোগী বা তৃতীয় পক্ষগুলি দ্বারা সরবরাহ করা যেতে পারে, এই শর্তাবলী এবং এই জাতীয় অন্যান্য শর্তাবলী দ্বারা নিয়ন্ত্রিত হবে৷ যা প্রযোজ্য হতে পারে (“অতিরিক্ত শর্তাবলী”)। যদি এই শর্তাদি কোনো অতিরিক্ত শর্তের সাথে অসামঞ্জস্যপূর্ণ হয়, তাহলে অতিরিক্ত শর্তাবলী প্রযোজ্য অতিরিক্ত শর্তাবলীর পরিমানে বাতিল হবে।

এই নথিটি তথ্য প্রযুক্তির পরিপ্রেক্ষিতে একটি ইলেকট্রনিক রেকর্ড, এর অধীনে প্রযোজ্য নিয়ম এবং বিভিন্ন আইনে ইলেকট্রনিক রেকর্ড সম্পর্কিত বিধান। এই ইলেকট্রনিক রেকর্ডটি একটি কম্পিউটার সিস্টেম দ্বারা তৈরি করা হয় এবং এর জন্য কোনো শারীরিক বা ডিজিটাল স্বাক্ষরের প্রয়োজন হয় না।

যেকোন ব্যক্তি যিনি আইন অনুসারে আইনিভাবে বাধ্যতামূলক চুক্তিতে প্রবেশ করতে পারেন, যেমন ১৮ বছর বা তার বেশি বয়সী ব্যক্তিদের মতো, সুস্থ মনের এবং কোনো আইন দ্বারা চুক্তিতে প্রবেশের অযোগ্য নয়, তারা ওয়েবসাইটটি ব্যবহার করতে এবং অ্যাক্সেস করতে পারেন।

এই শর্তাবলী ২ (দুই) অংশে বিভক্ত। দয়া করে শর্তাবলী সাবধানে পড়ুন।

অংশ ক – ওয়েবসাইট ব্যবহারের শর্তাবলী

১. সাধারণ

• ১.১ আপনার অ্যাক্সেস, বা অন্যথায় ওয়েবসাইটের যে কোনও ব্যবহারের অর্থ হল আপনি এই শর্তাবলীর সাথে সম্মত হন যা ওয়েবসাইটে উপলব্ধ সমস্ত নীতির সাথে পড়তে পারেন (সম্মিলিতভাবে, “চুক্তি”)৷

২. আপনারঅ্যাকাউন্টের নিবন্ধন

২.১ ওয়েবসাইটটি অ্যাক্সেস বা ব্যবহার করার জন্য আপনাকে অবশ্যই ওয়েবসাইটের সাইন-আপ পৃষ্ঠায় আপনার নাম, লিঙ্গ, মোবাইল নম্বর এবং অর্ডার দেওয়ার জন্য প্রাসঙ্গিক অন্যান্য বিশদ অন্তর্ভুক্ত থাকতে পারে এমন তথ্য প্রদান করে একটি অ্যাকাউন্ট সেট আপ করতে হবে আপনার অ্যাকাউন্টের মাধ্যমে। আপনার দ্বারা প্রদত্ত তথ্যের ভিত্তিতে আপনার লগইন আইডি এবং পাসওয়ার্ড তৈরি করা হবে, যা আপনি যেকোনো সময় আপনার ইমেডিসিন অ্যাকাউন্ট অ্যাক্সেস করতে ব্যবহার করতে পারেন। রেজিস্ট্রেশনের সময় আপনার দ্বারা শেয়ার করা পরিচয়পত্র এবং আপনার ইমেডিসিন লগইন আইডি এবং পাসওয়ার্ড “অ্যাকাউন্ট তথ্য” হিসাবে উল্লেখ করা হয়।

২.২ আপনার দ্বারা তৈরি অ্যাকাউন্ট পরিচালনা করার জন্য আপনি সম্পূর্ণরূপে অনুমোদিত৷ ফলস্বরূপ, আপনার অ্যাকাউন্টের তথ্যের গোপনীয়তা বজায় রাখা আপনার দায়িত্ব। আপনার অ্যাকাউন্টে আপনার দ্বারা সমস্ত কর্মের জন্য আপনি সম্পূর্ণরূপে দায়ী থাকবেন।

২.৩ আপনি: (ক) অবিলম্বে আপনার অ্যাকাউন্টের কোনো অননুমোদিত ব্যবহার বা নিরাপত্তা লঙ্ঘনের বিষয়ে আমাদের অবহিত করবেন এবং (খ) নিশ্চিত করুন যে আপনি প্রতিটি সেশনের শেষে আপনার অ্যাকাউন্ট থেকে লগ আউট করেছেন৷ আপনার অ্যাকাউন্টের তথ্য নিরাপদ, সুরক্ষিত এবং গোপনীয় রাখতে আপনার ব্যর্থতার ফলে প্যান ভেঞ্চারস বা অন্য কোনো ব্যবহারকারীর অ্যাকাউন্টের অননুমোদিত ব্যবহারের কারণে যে কোনো ক্ষতির জন্য আপনাকে দায়ী করা যেতে পারে। আমরা আপনাকে কোনো নোটিশ প্রদান না করে যে কোনো সময় ওয়েবসাইটে অ্যাক্সেস প্রত্যাখ্যান করার, অ্যাকাউন্ট বন্ধ বা স্থগিত করার, সামগ্রী অপসারণ বা সম্পাদনা করার অধিকার সংরক্ষণ করি।

২.৪ প্রতারণামূলক অ্যাকাউন্ট এবং লেনদেন এড়াতে আমরা ক্রমাগত ব্যবহারকারীর অ্যাকাউন্ট পর্যবেক্ষণ করি। একাধিক অ্যাকাউন্টের ব্যবহারকারী বা প্রতারণামূলকভাবে রেফারেল ভাউচার গ্রহণকারী ব্যবহারকারীরা প্রযোজ্য আইনের অধীনে আইনি পদক্ষেপের জন্য দায়বদ্ধ থাকবেন এবং আমরা পণ্যের মূল্য, লেনদেনের ফি, বা অ্যাটর্নি ফি সহ অন্যান্য সম্পর্কিত খরচ পুনরুদ্ধার করার অধিকার সংরক্ষণ করি। প্রতারণামূলকভাবে ওয়েবসাইট. একটি ইভেন্টে আমরা কোনো জালিয়াতি বা ব্যর্থ লেনদেন শনাক্ত করি, আইনি ব্যবস্থা নেওয়ার আগে, আমরা অবিলম্বে এই ধরনের অ্যাকাউন্ট স্থগিত বা মুছে ফেলার অধিকার সংরক্ষণ করি এবং আমাদের পক্ষ থেকে কোনো দায় ছাড়াই সমস্ত অতীত এবং মুলতুবি আদেশকে অসম্মান করি। যাইহোক, এটি ব্যবহারকারীকে কোনো দায় থেকে অব্যাহতি দেবে না।

৩. যোগাযোগএবং আনসাবস্ক্রিপশন

৩.১ আপনি বুঝতে পেরেছেন যে একবার আপনি আপনার অ্যাকাউন্টের তথ্য শেয়ার করেছেন এবং ওয়েবসাইটে সফলভাবে নিবন্ধন করেছেন, আপনি ওয়েবসাইটে আপনার নিবন্ধন এবং লেনদেন সম্পর্কিত ইমেডিসিন থেকে এসএমএস বা ইমেল বিজ্ঞপ্তি পেতে পারেন।

৩.২ আপনি যেকোন লেনদেন/বিপণন/প্রচারমূলক ক্রিয়াকলাপ সম্পর্কে যোগাযোগ, বিজ্ঞপ্তি এবং বাণিজ্যিক বার্তা পেতে সম্মতি দিচ্ছেন যা ওয়েবসাইটে আপনার লেনদেনের সাথে সম্পর্কিত বা সময়ে সময়ে ওয়েবসাইটে উপলব্ধ পণ্য এবং পরিষেবাগুলি। আপনার অ্যাকাউন্টের তথ্য শেয়ার করে এবং ওয়েবসাইটে নিবন্ধন করে এবং/অথবা আমাদের সাথে আপনার যোগাযোগ নম্বর যাচাই করে, আপনি স্পষ্টভাবে আমাদের এবং/অথবা আমাদের অনুমোদিত থেকে বিপণন/প্রচারমূলক যোগাযোগ (কল, এসএমএস, ইমেল বা অন্যান্য ডিজিটাল এবং ইলেকট্রনিক মাধ্যমে) পেতে সম্মতি দিচ্ছেন। কোনো নতুন পরিষেবা বা অফার সংক্রান্ত প্রতিনিধি।
৩.৩ যদিও কোম্পানি আপনাকে এই বিজ্ঞপ্তিগুলি এবং অনুস্মারকগুলি অবিলম্বে প্রদান করার চেষ্টা করে, কোম্পানি কোন গ্যারান্টি প্রদান করে না এবং আপনাকে এই ধরনের বিজ্ঞপ্তি/অনুস্মারক পাঠাতে ব্যর্থতার জন্য দায়ী বা দায়ী করা হবে না।

৩.৪ আপনি এই ধরনের যোগাযোগে সেট করা নির্দেশাবলী অনুসরণ করে যেকোন সময় কোম্পানির থেকে মার্কেটিং/প্রচারমূলক যোগাযোগ, নিউজলেটার এবং অন্যান্য বিজ্ঞপ্তি প্রাপ্তি থেকে সদস্যতা ত্যাগ/অনির্বাচন করতে পারেন।

৪. ব্যবহারকারীরওয়ারেন্টি এবং সীমাবদ্ধতা

৪.১ আপনি প্রতিনিধিত্ব করেন এবং ওয়ারেন্টি দেন যে: (ক) আপনার ওয়েবসাইট ব্যবহার কোনো প্রযোজ্য আইন বা প্রবিধান লঙ্ঘন করবে না; (খ) ওয়েবসাইটের সাথে কোম্পানির কাছে জমা দেওয়া সমস্ত তথ্য সত্য, নির্ভুল এবং আইনসম্মত; (গ) আপনার ওয়েবসাইটের ব্যবহার কোনো প্রযোজ্য ওয়েবসাইটের নীতি বা নির্দেশিকা লঙ্ঘন করে না এবং কোনো ব্যক্তি বা সত্তার ক্ষতির কারণ হবে না। যদি যেকোন সময়ে, আপনার দ্বারা প্রদত্ত তথ্যগুলি মিথ্যা বা ভুল বলে প্রমাণিত হয়, কোম্পানির নিবন্ধন প্রত্যাখ্যান করার, যেকোনো বা সমস্ত আদেশ বাতিল করার এবং ভবিষ্যতে কোনো পূর্বতথ্য ছাড়াই আপনাকে ওয়েবসাইট এবং অন্যান্য অনুমোদিত পরিষেবাগুলি ব্যবহার করা থেকে সীমাবদ্ধ করার অধিকার থাকবে জ্ঞাপন যাই হোক না কেন । আপনি তৃতীয় পক্ষের দ্বারা আনা সমস্ত দাবির জন্য কোম্পানি এবং এর সহযোগীদের ক্ষতিপূরণ দিতে সম্মত হন।

৪.২ আপনি ওয়েবসাইটটি শুধুমাত্র একটি বৈধ উদ্দেশ্যে ব্যবহার করবেন, এবং কোম্পানি বা ওয়েবসাইট বা এর বিষয়বস্তুর জন্য ক্ষতিকারক বা ওয়েবসাইটের মাধ্যমে অন্যথায় পরিকল্পিত নয় এমন কোনো কার্যকলাপ গ্রহণ করবেন না। এই শর্তাবলী সাপেক্ষে, শুধুমাত্র পরিষেবাগুলি পাওয়ার উদ্দেশ্যে, ওয়েবসাইট অ্যাক্সেস এবং ব্যবহার করার জন্য আপনার কাছে সীমিত লাইসেন্স রয়েছে।

৪.৩ আপনার দ্বারা ওয়েবসাইটের ব্যবহার শুধুমাত্র ব্যক্তিগত ব্যবহারের জন্য সীমাবদ্ধ, এবং আপনি এই ওয়েবসাইটের কোনো অংশ (প্ল্যাটফর্মের বিষয়বস্তু সহ) বা পরিষেবাগুলি কোনো পুনঃবিক্রয় বা বাণিজ্যিক উদ্দেশ্যে ব্যবহার করবেন না।

৪.৪ আপনি নিম্নলিখিত কোনটি করবেন না:

৪.৪.১ ওয়েবসাইট নেভিগেট করতে বা অনুসন্ধান করতে যেকোন ইঞ্জিন, সফ্টওয়্যার, টুল, এজেন্ট বা অন্যান্য প্রক্রিয়া (যেমন মাকড়সা, রোবট, আভাটার্স, ওয়ার্ম, টাইম বোমা ইত্যাদি) ব্যবহার করুন;

৪.৪.২ পণ্য, ওয়েবসাইট বা কোম্পানির বিরুদ্ধে মিথ্যা বা দূষিত বিবৃতি তৈরি করুন;

৪.৪.৩ পোস্ট, অনুলিপি, জমা, আপলোড, বিতরণ, বা অন্যথায় সফ্টওয়্যার বা অন্যান্য কম্পিউটার ফাইল যা ভাইরাস বা অন্যান্য ক্ষতিকারক উপাদান ধারণ করে, বা অন্যথায় ওয়েবসাইট বা কোনও সংযুক্ত নেটওয়ার্ককে ব্যাহত বা ক্ষতি করে, বা অন্যথায় হস্তক্ষেপ করে কোনো ব্যক্তি বা সত্তার ওয়েবসাইট ব্যবহার বা উপভোগ;

৪.৪.৪ কোনো ট্রোজান, ভাইরাস, অন্য কোনো ক্ষতিকারক সফ্টওয়্যার, কোনো বোটস বা কোনো তথ্যের জন্য ওয়েবসাইট স্ক্র্যাপ করুন;

৪.৪.৫ আমাদের দ্বারা বাস্তবায়িত যেকোন সিস্টেম, নিরাপত্তা বা প্রমাণীকরণ ব্যবস্থার দুর্বলতা যাচাই, স্ক্যান বা পরীক্ষা করা বা অন্যথায় আমাদের প্রযুক্তিগত নকশা এবং স্থাপত্যের সাথে হেরফের বা হস্তক্ষেপ করার চেষ্টা করা;

৪.৪.৬ হ্যাক ইন বা ওয়েবসাইটের কোনো ধরনের ক্ষতিকারক সফ্টওয়্যার প্রবর্তন;

৪.৪.৭ যেকোন ধরনের অসামাজিক, বিঘ্নাত্মক, বা ধ্বংসাত্মক কাজে জড়িত থাকুন, যার মধ্যে রয়েছে “ফ্লেমিং”, “স্প্যামিং”, “ফ্লাডিং”, “ট্রোলিং”, “ফিশিং” এবং “শোকিং” কারণ এই শব্দগুলো সাধারণত বোঝা যায় এবং ব্যবহার করা হয় ইন্টারনেটে।

৪.৫ আপনাকে হোস্ট করা, প্রদর্শন করা, আপলোড করা, পরিবর্তন করা, প্রকাশ করা, প্রেরণ করা, আপডেট করা বা ওয়েবসাইটের মাধ্যমে শেয়ার করা থেকে নিষিদ্ধ করা হয়েছে, যে কোনো তথ্য:

৪.৫.১ অন্য ব্যক্তির এবং যার উপর আপনার কোন অধিকার নেই;

৪.৫.২ ক্ষতিকারক, হয়রানিমূলক, নিন্দামূলক, মানহানিকর, অশ্লীল, পর্নোগ্রাফিক, পেডোফিলিক, অন্যের গোপনীয়তা আক্রমণকারী, ঘৃণাপূর্ণ, অর্থ পাচার বা জুয়া খেলার সাথে সম্পর্কিত বা উৎসাহিত করা, বা অন্যথায় যে কোনও উপায়ে ক্ষতিকারক;

৪.৫.৩ অপ্রাপ্তবয়স্কদের যে কোনো উপায়ে ক্ষতি করে;

৪.৫.৪ কোন পেটেন্ট, ট্রেডমার্ক, কপিরাইট বা অন্যান্য মালিকানা অধিকার লঙ্ঘন করে;

৪.৫.৫ আপাতত বলবৎ কোনো আইন লঙ্ঘন করে;

৪.৫.৬ এই ধরনের বার্তাগুলির উৎস সম্পর্কে ঠিকানাকে প্রতারিত বা বিভ্রান্ত করে বা এমন কোনও তথ্য যোগাযোগ করে যা মারাত্মকভাবে আপত্তিকর বা ভয়ঙ্কর প্রকৃতির;

৪.৫.৭ অন্য ব্যক্তির ছদ্মবেশ বা মানহানি; বা

৪.৫.৮ সফ্টওয়্যার ভাইরাস বা অন্য কোনো কম্পিউটার কোড, ফাইল বা প্রোগ্রাম রয়েছে যা কোনো কম্পিউটার সংস্থানের কার্যকারিতাকে বাধা, ধ্বংস বা সীমিত করার জন্য ডিজাইন করা হয়েছে

৫. বাংলাদেশেরবাইরে অ্যাক্সেস

• ৫.১ কোম্পানি কোন প্রতিনিধিত্ব করে না যে ওয়েবসাইটের বিষয়বস্তু গণপ্রজাতন্ত্রী বাংলাদেশের বাইরে ব্যবহার বা অ্যাক্সেস করার জন্য উপযুক্ত। যে কোন ব্যবহারকারী যে বাংলাদেশের বাইরে থেকে ওয়েবসাইট ব্যবহার করেন বা অ্যাক্সেস করেন, তারা নিজের ঝুঁকিতে তা করেন এবং এই ধরনের এখতিয়ারের আইন মেনে চলার জন্য দায়ী। এই শর্তাদি গঠিত হয় না, বা এই শর্তাদি যে কোনো এখতিয়ারের মধ্যে যে কোনো প্রচারমূলক কার্যকলাপ বা অনুরোধের জন্য বা তার সাথে যুক্ত হতে পারে যেখানে এই ধরনের প্রচারমূলক কার্যকলাপ বা অনুরোধ অনুমোদিত নয় বা এমন কোনো ব্যক্তির কাছে যাকে প্রচার করা বা অনুরোধ করা বেআইনি।

৬. দাবিত্যাগ

পণ্য

৬.১ আপনি উপযুক্ত মনে করলে পণ্য কেনার জন্য বা তৃতীয় পক্ষের পরিষেবাগুলি পেতে আপনাকে একটি ই-কমার্স ওয়েবসাইট সরবরাহ করার জন্য কোম্পানি সম্পূর্ণরূপে দায়ী৷

৬.২ এতদ্বারা এটি স্পষ্ট করা হয়েছে যে প্রযোজ্য আইনের অধীনে যে কোনও লেবেলিং, বাধ্যতামূলক ঘোষণার প্রয়োজনীয়তা ইত্যাদি সহ পণ্যগুলির উৎপাদন সম্পর্কিত সমস্ত সম্মতির জন্য নির্মাতারা নিজেরাই দায়ী৷ লিগ্যাল মেট্রোলজি অ্যাক্ট, ড্রাগস অ্যান্ড কসমেটিকস অ্যাক্ট, ফুড সেফটি অ্যান্ড স্ট্যান্ডার্ডস অ্যাক্ট ইত্যাদি এবং এর অধীনে প্রণীত নিয়মগুলি সহ প্রযোজ্য আইনগুলির প্রাসঙ্গিক বিধানগুলির অধীনে প্রস্তুতকারকদের অনুগত হতে বাধ্য।

৬.৩ ব্যবহারকারীদের তাদের পছন্দের পণ্য শনাক্ত করতে সহায়তা করার উপায় হিসাবে, প্রযোজ্য আইন দ্বারা অনুমোদিত পরিমাণে, আমরা গ্রাফিক্স, চিত্র, ফটোগ্রাফ, ছবি, ভিডিও, চার্ট, স্ক্রিনশট, তথ্য গ্রাফিক্স এবং সহ ওয়েবসাইটে ভিজ্যুয়াল উপস্থাপনা প্রদান করি অন্যান্য চাক্ষুষ সহায়ক। সঠিক ভিজ্যুয়াল উপস্থাপনা প্রদানের জন্য যুক্তিসঙ্গত প্রচেষ্টা করা হলেও, আমরা এই ধরনের ভিজ্যুয়াল উপস্থাপনা বা পণ্যের বর্ণনার নির্ভুলতার কোনো গ্যারান্টি বা ওয়ারেন্টি অস্বীকার করি।

৬.৪ আপনি বোঝেন যে ওয়েবসাইটটি আপনাকে ডাক্তার/নিবন্ধিত মেডিকেল প্র্যাকটিশনার এবং/অথবা ডায়াগনস্টিক পরিষেবা কেন্দ্রগুলির সাথে পরামর্শের জন্য সনাক্ত করতে এবং অ্যাপয়েন্টমেন্ট করতে সহায়তা করার জন্য তৃতীয় পক্ষের পরিষেবা সরবরাহ করতে পারে৷ অনুগ্রহ করে মনে রাখবেন যে এই পরিষেবাটি তৃতীয় পক্ষের দ্বারা প্রদান করা হয়, এবং ওয়েবসাইটটি এই ধরনের পরিষেবাগুলির সঠিকতা, সম্পূর্ণতা বা নির্ভুলতার বিষয়ে কোনও গ্যারান্টি দেয় না বা কোনও প্রতিনিধিত্ব করে না। প্রয়োজনে আপনার জরুরি সাহায্য বা ফলো-আপ যত্ন নেওয়া উচিত এবং আপনার উপযুক্ত মনে করতে পারেন আপনার প্রাথমিক স্বাস্থ্যসেবা প্রদানকারীর সাথে পরামর্শ করা চালিয়ে যান।

৬.৫ আপনার এবং তৃতীয় পক্ষের পরিষেবা প্রদানকারীর মধ্যে সমস্ত যোগাযোগ হল আপনার এবং এই জাতীয় তৃতীয় পক্ষের মধ্যে একটি পৃথক লেনদেন৷ আপনার দ্বারা প্রাপ্ত এই ধরনের তৃতীয় পক্ষের পরিষেবা থেকে উদ্ভূত কোনো দায় বা দাবি আপনার এবং এই জাতীয় তৃতীয় পক্ষের মধ্যে হবে। কোম্পানী এই ধরনের তৃতীয় পক্ষের সাথে আপনার যোগাযোগ, পরিষেবার সুবিধা (যার মধ্যে ঘাটতি, ঘাটতি এবং ভুলতা সহ কিন্তু সীমাবদ্ধ নয়) থেকে উৎভূত কোনো দায় অস্বীকার করে।

৬.৬ পণ্য এবং তৃতীয় পক্ষের পরিষেবাগুলি আপনাকে “যেমন আছে” ভিত্তিতে প্রদান করা হয়৷ আমরা পণ্য এবং তৃতীয় পক্ষের পরিষেবাগুলির পক্ষে কোনও প্রতিনিধিত্ব বা ওয়ারেন্টি করি না। কোম্পানি গুণমান, উপযুক্ততা, নির্ভুলতা, নির্ভরযোগ্যতা, কর্মক্ষমতা, নিরাপত্তা, ব্যবসায়িকতা, একটি নির্দিষ্ট উদ্দেশ্য/ব্যবহারের জন্য ফিটনেস বা বিষয়বস্তু (পণ্য বা মূল্যের তথ্য এবং/অথবা স্পেসিফিকেশন সহ) এর ক্ষেত্রে কোনো প্রতিনিধিত্ব এবং ওয়ারেন্টি প্রদান করে না। ওয়েবসাইট এবং পরিষেবাগুলি সব সময়ে উপলব্ধ করা হবে।

৭. প্রেসক্রিপশনঔষধ নীতি:

৮. ওয়েবসাইটের বিষয়বস্তু

৮.১ সমস্ত তথ্য, বিষয়বস্তু, উপাদান, পাঠ্য, গ্রাফিক্স, ছবি, লোগো, বোতাম আইকন, সফ্টওয়্যার কোড, ইন্টারফেস, ডিজাইন এবং ওয়েবসাইটে সামগ্রীর সংগ্রহ, বিন্যাস এবং সমাবেশ কোম্পানি বা এর সহযোগীদের সম্পত্তি (“ কোম্পানির বিষয়বস্তু”), এবং কপিরাইট, ট্রেডমার্ক এবং অন্যান্য প্রযোজ্য আইনের অধীনে সুরক্ষিত। আরও, ওয়েবসাইটে প্রদর্শিত হোক বা না হোক, সমস্ত ট্রেডমার্ক, পরিষেবার চিহ্ন, ট্রেড নাম এবং ওয়েবসাইট সম্পর্কিত ট্রেড সিক্রেট কোম্পানির মালিকানাধীন।

৮.২ কোম্পানি এই ধরনের ব্র্যান্ডের দ্বারা কোম্পানিকে প্রদত্ত লাইসেন্স অনুযায়ী যে কোনো তৃতীয় পক্ষের লোগো, ট্রেড নাম, অন্যান্য ব্র্যান্ডের ট্রেডমার্ক ওয়েবসাইটে প্রদর্শন করতে পারে৷

৮.৩ ওয়েবসাইট থেকে কোন তথ্য, বিষয়বস্তু বা উপাদান (কোম্পানির বিষয়বস্তু সহ) অনুলিপি, পুনঃউৎপাদন, পুনঃপ্রকাশ, সদৃশ, অনুলিপি, বিক্রি, পুনঃবিক্রয়, আপলোড, পোস্ট, প্রেরণ, বিতরণ বা অন্য কোন উপায়ে (কোনও সহ) শোষণ করা যাবে না বাণিজ্যিক উদ্দেশ্য) কোম্পানির এক্সপ্রেস লিখিত অনুমতি ছাড়া। আপনি স্পষ্ট লিখিত সম্মতি ব্যতীত কোম্পানি এবং এর সহযোগীদের কোন ট্রেডমার্ক, লোগো, বা অন্যান্য মালিকানাধীন তথ্য (ছবি, পাঠ্য, পৃষ্ঠার বিন্যাস, বা ফর্ম সহ) আবদ্ধ করতে ফ্রেমিং কৌশল ব্যবহার করবেন না বা ব্যবহার করবেন না। আপনি কোম্পানি এবং/অথবা এর সহযোগীদের স্পষ্ট লিখিত সম্মতি ছাড়া কোম্পানির বা এর সহযোগীদের নাম বা ট্রেডমার্ক ব্যবহার করে কোনো মেটা ট্যাগ বা অন্য কোনো “লুকানো পাঠ্য” ব্যবহার করতে পারবেন না, যেমন প্রযোজ্য। যেকোনো অননুমোদিত ব্যবহার এই শর্তাবলীতে প্রদত্ত অনুমতি বাতিল করে।

৯. আপনার সামগ্রীর লাইসেন্স এবং ব্যবহার

৯.১ আপনার ওয়েবসাইট, পরিষেবার ব্যবহার এবং কোম্পানির বিষয়বস্তুর অ্যাক্সেস (নিচে সংজ্ঞায়িত করা হয়েছে) একটি সীমিত, প্রত্যাহারযোগ্য এবং অ-এক্সক্লুসিভ লাইসেন্সের সাপেক্ষে যা আপনি যখন ওয়েবসাইটে নিবন্ধন করেন তখন আপনাকে দেওয়া হয়। আপনি ওয়েবসাইটটি শুধুমাত্র পণ্য শনাক্ত করার জন্য, পণ্যের ক্রয় এবং রিটার্ন এবং রিফান্ড প্রক্রিয়াকরণের জন্য ওয়েবসাইটের রিটার্ন এবং রিফান্ড নীতি অনুসারে, শুধুমাত্র আপনার ব্যক্তিগত ব্যবহারের জন্য ব্যবহার করবেন এবং ব্যবসায়িক উদ্দেশ্যে নয়।

৯.২ আপনাকে প্রদত্ত লাইসেন্স এর জন্য লাইসেন্স অন্তর্ভুক্ত করে না: (ক) পণ্যের পুনঃবিক্রয় বা ওয়েবসাইট বা কোম্পানির বিষয়বস্তুর বাণিজ্যিক ব্যবহার, (খ) পণ্যের তালিকা, বিবরণ, বা মূল্যের যেকোনো সংগ্রহ এবং ব্যবহার, (গ) ওয়েবসাইট, পরিষেবা এবং/অথবা কোম্পানির বিষয়বস্তুর যে কোনো ব্যবহার এই শর্তাবলীতে বিবেচনা করা ছাড়া, (ঘ) অ্যাকাউন্টের তথ্য ডাউনলোড বা অনুলিপি করা, (ঙ) ডেটা মাইনিং, রোবট বা অনুরূপ ডেটা সংগ্রহের কোনো ব্যবহার এবং এক্সট্র্যাকশন টুলস এক্সট্র্যাক্ট করার জন্য (একবার বা বহুবার) ওয়েবসাইটের যেকোনো অংশ, (ঙ) আপনার নিজস্ব ডাটাবেস তৈরি এবং/বা প্রকাশ করা যা ওয়েবসাইটের কিছু অংশ বৈশিষ্ট্যযুক্ত।

৯.৩ আপনি কোম্পানিকে একটি রয়্যালটি-মুক্ত, চিরস্থায়ী, অপরিবর্তনীয়, অ-একচেটিয়া অধিকার এবং লাইসেন্স গ্রহণ, প্রকাশ, পুনউৎপাদন, প্রচার, প্রেরণ, বিতরণ, অনুলিপি, ব্যবহার, ডেরিভেটিভ কাজ তৈরি, বিশ্বব্যাপী প্রদর্শন, বা কাজ করার লাইসেন্স প্রদান করেন এই ধরনের বিষয়বস্তুতে বিদ্যমান যেকোনো অধিকারের পূর্ণ মেয়াদের জন্য এখন পরিচিত বা পরে বিকশিত কোনো ফর্ম, মিডিয়া, বা প্রযুক্তিতে অতিরিক্ত অনুমোদন বা বিবেচনা ছাড়াই আপনার দ্বারা ওয়েবসাইটে পোস্ট করা কোনো উপাদান, এবং আপনি সমস্ত প্রতিক্রিয়ার উপর কোনো দাবি পরিত্যাগ করেন, মন্তব্য, ধারনা বা পরামর্শ বা ওয়েবসাইটের মাধ্যমে বা দেওয়া অন্য কোন বিষয়বস্তু। আপনি কোম্পানিকে প্রদত্ত উপরোক্ত অধিকারগুলির যেকোনও নিখুঁত করার জন্য প্রয়োজনীয় সমস্ত কাজ সম্পাদন করতে সম্মত হন, এর অনুরোধে দলিল এবং দলিল সম্পাদন সহ।

১১. আমাদের বিক্রয় চুক্তি

১১.৫ আমাদের কাছ থেকে যেকোন যোগাযোগ শুধুমাত্র আপনার নিবন্ধিত মোবাইল নম্বর এবং/অথবা ইমেল ঠিকানা বা এই ধরনের অন্য যোগাযোগ নম্বর বা ইমেল ঠিকানায় পাঠানো হবে যা আপনি নির্দিষ্ট লেনদেনের জন্য মনোনীত করতে পারেন। আপনার নিবন্ধিত মোবাইল নম্বর এবং/অথবা ওয়েবসাইটটিতে ইমেল ঠিকানা আপডেট করার জন্য আপনি এককভাবে দায়ী থাকবেন যদি কোনো পরিবর্তন হয়। এছাড়াও, আমরা আপনাকে ক্রয়কৃত পণ্যের নির্ধারিত বিতরণের ক্ষেত্রে বিজ্ঞপ্তি এবং অনুস্মারক পাঠাতে পারি। যদিও আমরা আপনার সাথে ক্রয়কৃত পণ্য(গুলি) সরবরাহের সাথে সম্পর্কিত প্রম্পট অনুস্মারক এবং বিজ্ঞপ্তিগুলি ভাগ করার জন্য সর্বাত্মক প্রচেষ্টা করব, আমরা আপনাকে এই ধরনের বিজ্ঞপ্তি বা অনুস্মারক পাঠাতে ব্যর্থতার জন্য দায়বদ্ধ হব না।

১১.৬ অনুগ্রহ করে মনে রাখবেন যে আমরা প্রেসক্রিপশন অনুযায়ী প্রয়োজনের সাথে সামঞ্জস্যপূর্ণ পরিমাণে পণ্য সরবরাহ করি।

১১.৭ ওয়েবসাইটে স্থাপিত সমস্ত অর্ডার এই ধরনের পণ্যের প্রাপ্যতা, উপরোক্ত অনুসারে আপনার অফারে আমাদের গ্রহণযোগ্যতা এবং এই শর্তাবলীর প্রতি আপনার অবিরত আনুগত্য সাপেক্ষে।

১১.৮ আপনি এতদ্বারা আপনার পক্ষ থেকে অনুরোধের ভিত্তিতে যেকোনো সরকারী কর্তৃপক্ষকে ঘোষণা এবং ঘোষণা প্রদান করার জন্য আমাদের অনুমোদন দিচ্ছেন, যার মধ্যে আপনার দ্বারা আদেশকৃত পণ্যগুলি ব্যক্তিগত, অ-বাণিজ্যিক ব্যবহারের জন্য।

১২. রিটার্ন এবং রিফান্ড

১৩. পণ্যের প্রাপ্যতা

১৪. পণ্যেরমূল্য নির্ধারণ

১৪.১ সমস্ত মূল্য বাংলাদেশী টাকা তালিকাভুক্ত করা হয়েছে৷ মূল্য, প্রদর্শিত হিসাবে, সমস্ত প্রযোজ্য কর সহ।

১৪.২ ওয়েবসাইটের আপনার শপিং কার্টে থাকা পণ্যগুলি ওয়েবসাইটের পণ্যের তথ্য ওয়েবপেজে প্রদর্শিত সবচেয়ে সাম্প্রতিক মূল্যকে প্রতিফলিত করবে। অনুগ্রহ করে মনে রাখবেন যে এই দামটি পণ্যটির জন্য দেখানো মূল্য থেকে ভিন্ন হতে পারে যখন আপনি এটিকে প্রথমবার আপনার শপিং কার্টে রেখেছিলেন। আপনার শপিং কার্টে একটি পণ্য স্থাপন করা সেই সময়ে দেখানো মূল্য সংরক্ষণ করে না। এটাও সম্ভব যে একটি পণ্যের মূল্য আপনি আপনার শপিং কার্টে রাখার সময় এবং আপনি অর্ডার দেওয়ার সময়ের মধ্যে পরিবর্তিত হতে পারে। অর্ডার দেওয়ার সময় প্রযোজ্য মূল্য চূড়ান্ত হবে।

১৫. লাইসেন্স

১৫.১ আপনি স্বীকার করেন যে আপনার দ্বারা নির্দিষ্ট পণ্য(গুলি) ব্যবহার, ক্রয় বা অন্যথায় অধিকার করার জন্য প্রযোজ্য আইনের অধীনে লাইসেন্স/অনুমতি প্রয়োজন হতে পারে। আপনি এই ধরনের লাইসেন্স/অনুমতি পাওয়ার জন্য এবং এই ধরনের লাইসেন্স/অনুমতিগুলির শর্তাবলী মেনে চলার জন্য সম্পূর্ণভাবে দায়ী থাকবেন।

১৬. দায়বদ্ধতারসীমাবদ্ধতা

১৬.১ কোনো অবস্থাতেই, আমাদের সামগ্রিক দায়, আপনার কাছ থেকে নেওয়া অর্থের বাইরে প্রসারিত হবে না এমন একটি আদেশ অনুসারে করা ক্রয়ের জন্য যার অধীনে এই ধরনের দায় তৈরি হয়েছে এবং প্রতিষ্ঠিত হয়েছে৷ আমরা কোনো ব্যবসায়িক ক্ষতির জন্য দায়ী থাকব না (লাভ, রাজস্ব, চুক্তি, প্রত্যাশিত সঞ্চয়, ডেটা, সদিচ্ছা বা নষ্ট ব্যয় সহ) বা অন্য কোনো পরোক্ষ বা ফলস্বরূপ ক্ষতি যা আপনার এবং আমাদের উভয়ের জন্য যুক্তিসঙ্গতভাবে অনুমানযোগ্য নয় যখন একটি চুক্তি আপনার কাছে আমাদের দ্বারা পণ্য বিক্রয় গঠিত হয়েছিল।

১৭. বিবিধ

১৭.১ ফোর্স ম্যাজিউর

আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে এমন কোনো কারণে বিলম্ব বা ব্যর্থতা দেখা দিলে তার বাধ্যবাধকতা মেনে চলতে কোনো বিলম্ব বা ব্যর্থতার জন্য আমরা দায়ী থাকব না।

১৭.২ ছাড়

এই শর্তাবলীর কোন বিধান মওকুফ বলে গণ্য হবে না এবং কোন লঙ্ঘন ক্ষমা করা হবে না, যদি না এই ধরনের দাবিত্যাগ বা সম্মতি আমাদের দ্বারা লিখিত এবং স্বাক্ষরিত হয়। আমাদের দ্বারা কোনো সম্মতি, বা আপনার লঙ্ঘনের দাবিত্যাগ, প্রকাশ করা বা উহ্য, অন্য কোনো ভিন্ন বা পরবর্তী লঙ্ঘনের জন্য সম্মতি, দাবিত্যাগ বা অজুহাত গঠন করবে না।

১৭.৩ বিভাজনযোগ্যতা

যদি এই শর্তাবলীর কোনো বিধান প্রযোজ্য আইনের অধীনে কার্যকরী অধিক্ষেত্রের আদালতের দ্বারা অপ্রয়োগযোগ্য বলে ধরে থাকে, তাহলে এই ধরনের বিধান এই শর্তাবলী থেকে বাদ দেওয়া হবে এবং এই শর্তাবলীর বাকি অংশগুলিকে এমনভাবে ব্যাখ্যা করা হবে যেন এই ধরনের বিধান এতটাই বাদ দেওয়া হয়েছে এবং বলবৎযোগ্য হবে। এর শর্তাবলী অনুসারে; শর্ত থাকে যে, এই ধরনের ঘটনাতে, এই শর্তাবলী ব্যাখ্যা করা হবে যাতে কার্যকর করতে, প্রযোজ্য আইনের সাথে সামঞ্জস্যপূর্ণ এবং অনুমোদিত সর্বাধিক পরিমাণে, বাদ দেওয়া বিধানের অর্থ এবং উদ্দেশ্য যেমন উপযুক্ত এখতিয়ারের আদালত দ্বারা নির্ধারিত হয়।

১৭.৪ সংশোধনী

এই শর্তাবলী সংশোধন এবং পরিবর্তন সাপেক্ষে এবং সময়ে সময়ে আপডেট করা যেতে পারে, কোনো আগাম বিজ্ঞপ্তি ছাড়াই। আপনাকে নিয়মিতভাবে ওয়েবসাইটে উপলব্ধ শর্তাবলী পর্যালোচনা করার জন্য অনুরোধ করা হচ্ছে। ওয়েবসাইটের সাথে আপনার সম্পর্ক এই শর্তাবলীর সবচেয়ে বর্তমান সংস্করণ দ্বারা পরিচালিত হবে, যেমনটি ওয়েবসাইটে প্রকাশিত হয়েছে।

The website, www.emedicine.com.bd along with the corresponding mobile application (“Emedicine”, “Website”, “Pharmacy”, “us” or “we”). This Website is managed and operated by PAN Ventures Limited, a company incorporated under the laws of Bangladesh, having its registered office at Mirpur, Dhaka, Bangladesh (“we”, “Company”, “Reliance” “us” or “our”)

The terms and conditions as set out herein (“Terms”) constitutes an agreement between the Company, and a natural or legal person who accesses and/or uses the Website in any manner (“you” or “your”).

The Website is a platform that facilitates online purchase by consumers of pharmaceutical products like prescription drugs, over the counter medicines etc., sold by Emedicine through its licensed premises (“Products”).

By using the Website, you expressly agree to be bound by the Terms. If you do not agree with any of the Terms, please refrain from using the Website. Please note that your usage of the Website, the Products, offers or promotions in relation to the Products and the Services (defined below) as may be provided by us or our affiliates or third parties, shall be governed by these Terms and such other terms that may be applicable (“Additional Terms”). If these Terms are inconsistent with any Additional Terms, the Additional Terms will supersede to the extent of the Additional Terms are applicable.

This document is an electronic record in terms of Information Technology, the applicable rules thereunder and the provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Any individual who can enter into legally binding contracts as per law, like individuals who are 18 years of age or older, are of sound mind, and are not disqualified from entering into contracts by any law, can use and access the Website.

THESE TERMS ARE DIVIDED INTO 2 (TWO) PARTS. PLEASE READ THE TERMS CAREFULLY.

PART A: TERMS FOR USAGE OF THE WEBSITE

1. GENERAL

1.1 Your access, or otherwise any usage of the Website means you agree to these Terms read with all the policies that may be available on the Website (collectively, the “Agreement”).

2. REGISTRATION OF YOUR ACCOUNT

2.1 In order to access or use the Website you must set up an account by providing information about yourself as prompted on the sign-up page of the Website which may include your name, gender, mobile number and such other details relevant for placing orders through your account. Your login ID and password will be created basis the information provided by you, which you can use to access your Emedicine account at any time. Your credentials shared by you at the time of registration and your Emedicine login ID and password are referred to as “Account Information”.

2.2 You are solely authorized to operate the account created by you. Consequently, it is your responsibility to maintain the confidentiality of your Account Information. You shall remain solely responsible for all the actions by you on your account.

2.3 You will: (a) immediately inform us of any unauthorized use or security breach of your account, and (b) ensure that you log out of your account at the end of each session. You may be held responsible for any losses incurred to PAN Ventures or any other user due to unauthorized use of their account, resulting from your failure to keep your Account Information safe, secure and confidential. We reserve the right to refuse access to the Website, terminate or suspend accounts, remove or edit content at any time without providing any notice to you.

2.4 We constantly monitor the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral vouchers fraudulently shall be liable for legal actions under the applicable law and we reserve the right to recover the cost of Products, transaction fees, or any other related cost including attorney fees, from such person using the Website fraudulently. In an event we detect any fraudulent or failed transaction, prior to initiation of legal action, we reserve the right to suspend or delete such account with immediate effect and dishonor all past and pending orders without any liability on our part. However, this shall not absolve the User from any liability.

3. COMMUNICATION AND UNSUBSCRIPTION

3.1 You understand that once you have shared your Account Information and successfully registered on the Website, you may receive SMS or email notifications from Emedicine relating to your registration and transactions on the Website.

3.2 You consent to receive communications, notifications and commercial messages regarding any transaction / marketing / promotional activities that are related to your transaction on the website or the Products and Services that maybe available on the Website from time to time. By sharing your Account Information and registering on the Website and/ or verifying your contact number with us, you explicitly consent to receive marketing / promotional communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings.

3.3 While the Company endeavours to provide these notifications and reminders to you promptly, the Company does not provide any guarantee and will not be held liable or responsible for any failure to send such notifications/reminders to you.

3.4 You can unsubscribe/opt-out from receiving marketing/promotional communications, newsletters and other notifications from the Company at any time by following the instructions set out in such communications.

4. USER WARRANTIES AND RESTRICTIONS

4.1 You represent and warrant that: (a) your use of the Website will not violate any applicable law or regulation; (b) all information that is submitted to the Company in connection with the Website is true, accurate and lawful; (c) Your use of the Website does not breach any applicable Website policies or guidelines and will not cause injury to any person or entity. If at any time, the information provided by you is found to be false or inaccurate the Company will have the right to reject registration, cancel any or all orders, and restrict you from using the Website and other affiliated services in the future without any prior intimation whatsoever. You agree to indemnify the Company and its affiliates for all claims brought by a third party.

4.4.4 Introduce any trojans, viruses, any other malicious software, any bots or scrape the Website for any information;

4.4.5 Probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us or otherwise tamper or attempt to tamper with our technological design and architecture;

4.4.6 Hack into or introduce malicious software of any kind onto the Website;

4.4.7 Engage in any form of antisocial, disruptive, or destructive acts, including “flaming,” “spamming,” “flooding,” “trolling,”, “phishing” and “griefing” as those terms are commonly understood and used on the internet.

4.5 You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing on or through the Website, any information that:

4.5.1 belongs to another person and to which you do not have any right;

4.5.2. is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, hateful, relating to or encouraging money laundering or gambling, or otherwise harmful in any manner whatsoever;

4.5.3. harms minors in any way;

4.5.4. infringes any patent, trademark, copyright or other proprietary rights;

4.5.5. violates any law for the time being in force;

4.5.6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

4.5.7. impersonates or defames another person; or

4.5.8. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource

5. ACCESS OUTSIDE BANGLADESH

5.1 The Company makes no representation that the content on the Website is appropriate to be used or accessed outside the People’s Republic of Bangladesh. Any user who use or access the Website from outside the Bangladesh, do so at their own risk and are responsible for compliance with the laws of such jurisdiction. These Terms do not constitute, nor may these Terms be used for or in connection with any promotional activities or solicitation by anyone in any jurisdiction in which such promotional activities or solicitation are not authorized or to any person to whom it is unlawful to promote or solicit.

6. DISLAIMER

PRODUCTS

6.1 The Company is solely responsible for providing you with an e-commerce website to purchase Product or avail third party services, if you deem fit.

6.2 It is hereby clarified that that the manufacturers themselves are responsible for all compliances relating to the manufacturing of the Products including any labeling, mandatory declaration requirements, etc. under the applicable law. The manufacturers are liable to be compliant under the relevant provisions of applicable laws, including but not limited to the Legal Metrology Act, Drugs and Cosmetics Act, Food Safety and Standards Act, etc. and the rules made thereunder.

6.3 As a means to assist the users in identifying the Products of their choice, to the extent permitted by applicable law, we provide visual representations on the Website including graphics, illustrations, photographs, images, videos, charts, screenshots, info graphics and other visual aids. While reasonable efforts are made to provide accurate visual representation, we disclaim any guarantee or warranty of accuracy of such visual representation or description of the Products.

6.4 You understand that the Website may provide third-party services to help you locate and make appointments for consultation with doctor/registered medical practitioners and/or diagnostics service centers. Please note that this service is provided by third-party, and the Website does not guarantee nor make any representation with respect to the correctness, completeness or accuracy of such services. You should seek emergency help or follow-up care when required and continue to consult your primary health care provider as you may deem fit.

6.5 All communication between you and the third party service provider is a separate transaction between you and such third-parties. Any liability or claim arising out of such third party services availed by you shall be between you and such third party. The Company disclaims any liability that may arise out of your communication, availment of services (including but not limited to deficiency, shortcoming, and inaccuracy) with such third parties.

6.6 The products and the third party services are provided to you on an “as is” basis. We do not make any representations or warranties on behalf of the products and third party services. The company does not covenant or provide any representations and warranties in respect of quality, suitability, accuracy, reliability, performance, safety, merchantability, fitness for a particular purpose/consumption or the content (including product or pricing information and/or specifications) on the Website and that the services will be made available at all times.

7. PRESCRIPTION MEDICATION POLICY:

7.1 The Website allows you to purchase the Products (prescription medicine) against a valid medical prescription issued by a medical expert/ doctor to be provided to a registered pharmacist for the purpose of dispensing such medicine (“Prescription Drugs”), offered for sale on the Website. In order to purchase Prescription Drugs from the Website, You are required to upload a scanned copy of the valid prescription on the Website or email the same to the Company. The order would not be processed by the Company until it receives a copy of a valid prescription. The Company will verify the prescription forwarded by You and in case we observe any discrepancy in the prescription uploaded by You, we will cancel the order immediately.

8. CONTENT ON THE WEBSITE

8.1 All information, content, material, text, graphics, images, logos, button icons, software code, interface, design and the collection, arrangement and assembly of the content on the Website are the property of the Company or its affiliates (“Company Content”), and are protected under copyright, trademark and other applicable laws. Further, all trademarks, services marks, trade names and trade secrets in relation to the Website whether or not displayed on the Website, are proprietary to the Company.

8.2 The Company may display on the Website any third-party logos, trade names, trademarks of other brands, as per the license granted to the Company by such brands.

9.1 Your use of the Website, the Services, and access to the Company Content (as defined below) is subject to a limited, revocable and non-exclusive license which is granted to you when you register on the Website. 10. INDEMNIFICATION AND LIMITATION OF LIABILITY

PART B – TERMS OF SALE ON THE WEBSITE

11. OUR CONTRACT OF SALE

11.1 Listing and display of a Product by us on the Website is our invitation to you to make an offer for purchase of such Product. Likewise, the placement of an order on the Website by you is your offer to buy the Product(s) from us.

11.2 Once you have placed an order with us for purchase of a Product, you will receive an e-mail and/or mobile confirming receipt of your order and containing the details of your order (the “Order Confirmation”). The Order Confirmation is merely an acknowledgement that we have received your order and does not signify our acceptance of your offer.

11.3 We only accept your offer and conclude the contract of sale for a Products ordered by you, when the Product is shipped or dispatched to you and an e-mail confirmation and/or confirmation to your registered mobile number is sent stating that the Product has been shipped or dispatched (the “Shipment Confirmation”). We reserve the right, at our sole discretion, to refuse or cancel any order for any reason whatsoever before sending Shipment Confirmation to you.

11.4 If your order is dispatched in more than one package, you may receive separate Shipment Confirmations for each package, and each Shipment Confirmation and corresponding dispatch will conclude a separate contract of sale between you and us for the Product(s) specified in that Shipment Confirmation.

11.5 Any communication from us shall be sent only to your registered mobile number and/or email address or such other contact number or email address that you may designate, for any particular transaction. You shall be solely responsible to update your registered mobile number and/or email address on the Website in the event there is a change. Further, we may also send you notifications and reminders with respect to scheduled deliveries of the purchased Products. While we shall make every endeavour to share prompt reminders and notifications relating to the delivery of purchased Product(s) with you, we shall not be held liable for any failure to send such notifications or reminders to you.

11.6 Please note that we dispense Products only in quantities which correspond to requirement as per the prescription.

11.7 All orders placed on the Website are subject to the availability of such Products, our acceptance of your offer as per the above and your continued adherence to these Terms.

11.8 You hereby authorise us to declare and provide declarations to any governmental authority on request on your behalf, including that the Products ordered by you are for personal, non-commercial use.

12. RETURN AND REFUND
